Claim Number: ALL-UBR-2026-552097 Dear Claims Adjuster, Please accept this correspondence as a formal demand for settlement of the above-captioned matter. Our office represents Ms. Sofia Martinez in connection with injuries sustained on 12/30/2025 when the Uber vehicle in which she was a fare-paying passenger was rear-ended at the intersection of West 42nd Street and 8th Avenue in Manhattan. LIABILITY Liability is uncontested. The dashcam footage we have produced shows the adverse driver striking the rear of our client's Uber vehicle at approximately 25mph while our client's vehicle was stopped at a red light. The police accident report (Aided Report #2026-MN-44192) corroborates this account; the responding officer noted no contribution by the Uber driver. INJURIES AND TREATMENT Ms. Martinez was transported by ambulance to Mount Sinai West for emergency evaluation. Initial imaging revealed a C5-C6 disc herniation with right-sided radiculopathy, a partial tear of the right rotator cuff, and signs consistent with a mild traumatic brain injury. Subsequent treatment has included: • MRI of the cervical and lumbar spine (Advanced Diagnostic Imaging) • Neurology consultation with Dr. Helen Sharma, confirmed mTBI with post-concussive syndrome • 18 sessions of physical therapy through Queens Sports Medicine, ongoing • Three cervical epidural steroid injections under Dr. Adam Rosenberg • Orthopedic follow-up for the shoulder; conservative management to date SPECIAL DAMAGES Medical bills to date.............. $45,200.00 Lost wages (16 weeks)............... $12,100.00 Future medical (projected).......... DEMAND In light of the foregoing, demand is hereby made in the sum of ONE HUNDRED EIGHTY-FIVE THOUSAND DOLLARS ($185,000.00) in full settlement of Ms. Martinez's claims.
